Terms & Conditions

These Terms & Conditions govern the use of the TaxiLoyal / Loyal Airport Service platform as well as the booking and performance of rides (in particular airport transfers) via our systems.

1. Scope of application

These Terms & Conditions apply to all contracts and bookings made via the TaxiLoyal / Loyal Airport Service platform (hereinafter referred to as the "platform") between passengers and the executing taxi or hire car companies.

Any deviating terms and conditions of the passenger shall not apply unless expressly agreed by us in writing.

2. Role of TaxiLoyal / Loyal Airport Service

TaxiLoyal / Loyal Airport Service acts as an intermediary platform for licensed and verified taxi companies and provides technical systems for booking rides. The platform is operated by:

The transport contract is concluded exclusively between the passenger and the executing taxi company. TaxiLoyal / Loyal Airport Service does not become a contractual party to the transport service itself.

3. Booking and conclusion of contract

Bookings can be made in particular via the online booking system, via app, e-mail or by phone. The entry of trip data by the passenger initially constitutes a non-binding request.

A booking is only deemed binding once it has been explicitly confirmed – exclusively in written form (e.g. by e-mail, SMS or app confirmation). Verbal confirmations do not constitute a binding pick-up guarantee.

If no confirmation is sent, no transport contract is concluded and there is no entitlement to the performance of the ride.

4. Prices and payment

Unless otherwise stated, all prices are final prices per vehicle, including statutory taxes. The prices displayed in the system at the time of booking or communicated individually are decisive.

Payment is usually made directly to the driver (cash or card, as far as available) or – subject to a separate agreement – by invoice (e.g. for registered corporate customers).

Additional services (e.g. child seats, extra stops, waiting times, night surcharges) may be charged separately if provided for in the booking or in these Terms & Conditions.

5. Obligations of the passenger

The passenger is obliged to provide all required information (name, contact details, pick-up address, destination address, date, time, number of passengers, luggage, flight number where applicable) fully and truthfully.

Changes (e.g. flight times, pick-up location, number of passengers) must be communicated to the operator or the executing company without delay. Delays due to incorrect or incomplete information are at the passenger’s risk.

The passenger is responsible for being ready for departure at the agreed meeting point at the agreed pick-up time.

6. Performance of the ride

The performance of the ride is the sole responsibility of the executing taxi company and its driver. The company is responsible for compliance with all legal requirements (licensing, driver permits, vehicle condition, transport obligations).

The driver is entitled to refuse passengers if safety concerns exist (e.g. highly intoxicated persons, endangerment of safe operation) or if required by applicable laws and regulations.

7. Waiting times, delays and no-show

Unless otherwise agreed, the driver will wait a reasonable period of time after the agreed pick-up time (e.g. 10–15 minutes). Thereafter, the ride may be considered a no-show and charged accordingly.

For airport pick-ups, the actual arrival time will be considered if the flight number has been provided. Delays caused by baggage handling, passport control or other individual circumstances of the passenger remain the passenger’s responsibility.

8. Cancellations

Cancellations are – unless otherwise agreed – possible free of charge up to a certain time before the ride (e.g. 12 or 24 hours). The exact deadlines may vary depending on the tariff or individual agreement.

If cancellation is not made in time or the passenger does not appear (no-show), a cancellation fee or the full fare may be charged.

9. Rides with children, luggage and special requests

For rides with children, the applicable legal requirements regarding child safety seats must be observed. The passenger must indicate at the time of booking if child seats are required.

Bulky or special luggage (e.g. skis, wheelchairs, animals) must be indicated when booking so that a suitable vehicle can be arranged.

10. Liability

The TaxiLoyal / Loyal Airport Service platform solely intermediates rides to legally licensed and verified taxi companies. We do not accept any liability for the actual performance of rides, the condition of vehicles or the conduct of drivers, as these aspects are the sole responsibility of the respective partner companies.

We in particular ensure that our partner companies hold the required commercial licences and that their drivers hold a valid taxi driver permit. Rides are generally invoiced directly between the passenger and the executing company. Exceptions may apply only for separately agreed invoicing arrangements with registered key accounts.

We are liable only in cases of intent or gross negligence. Any further liability, in particular for consequential damages, indirect damages or loss of profit, is – as far as legally permissible – excluded.

11. Data protection

The processing of personal data is carried out in accordance with our privacy policy, which forms an integral part of these Terms & Conditions.

12. Changes to services

We reserve the right to change our services, our platform or the technical systems used at any time, provided that this does not unreasonably disadvantage already confirmed bookings.

13. Amendments to these Terms & Conditions

We may amend these Terms & Conditions from time to time. The current version is available on our website. For new bookings, the Terms & Conditions in force at the time of booking apply.

14. Applicable law and place of jurisdiction

These Terms & Conditions are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

Unless a mandatory place of jurisdiction for consumers applies, the exclusive place of jurisdiction is Vienna, Austria.

15. Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr .

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
